Recommended Arbitration Clauses

In order all disputes, disagreements or demands arising from the contracts or related thereto to be settled in Lithuanian Court of Arbitration, it is recommended to improve your contract by amending it with such arbitration clause:

„Any dispute, disagreement or claim arising out of or relating to this contract, breach, termination or validity thereof, shall be finally settled by the arbitration in the Lithuanian Court of Arbitration (identification code 302473236) in accordance with its Rules of Procedure for Arbitration.“

In order to make a process faster and more efficient, we strongly suggest supplementing an arbitration clause with agreement on the language, place of arbitration and number of arbitrators. We recommend in the event of simple or relatively low-value contracts to specify that the dispute shall be settled by a single arbitrator. Such provision will speed up and simplify the process:

„Any dispute, disagreement or claim arising out of or relating to this contract, breach, termination or validity thereof, shall be finally settled by the arbitration in the Lithuanian Court of Arbitration (identification code 302473236) in accordance with its Rules of Procedure for Arbitration. Disputes shall be settled by a single arbitrator, arbitration proceedings shall be held in Vilnius in the Lithuanian language.“

It should be noted, that in disputes arising from the road transport carriage, the arbitration clause meeting the requirements of the CMR is recommended:

„Any dispute, disagreement or claim arising out of or relating to this contract, breach, termination or validity thereof, shall be finally settled by the arbitration in the Lithuanian Court of Arbitration (identification code 302473236) in accordance with its Rules of Procedure for Arbitration. Disputes shall be settled by a single arbitrator, arbitration proceedings shall be held in Vilnius in the Lithuanian language. The Arbitration Court shall apply Convention on the Contract for the International Carriage of Goods by Road (CMR) – (Geneva, 19 May 1956)”
